Nobel Biocare Disseminates False And Misleading Information About Implant Direct In An Attempt To Preserve Its Canadian Sales And High Prices

To Canadian Customers of Implant Direct and Nobel Biocare:

Implant Direct will sell over 100,000 Nobel compatible implants in 2009. Nobel, in an attempt to recapture some of this lost business while sustaining its high prices, instituted a strategy to discredit Implant Direct in Canada. Ms. Adele Fussi, a disgruntled former Implant Direct employee, used Implant Direct's confidential information to instigate a Health Canada investigation while negotiating for a high paying position with Nobel Biocare. According to a Sworn Declaration, Ms. Fussi related that her job with Nobel would entail, "..spend(ing) time with all of Nobel's sales managers, targeting Implant Direct's key accounts, and teach(ing) Nobel's employees how to best use the cracked vial cap information to sell against Implant Direct." She filed a misleading report with Health Canada that resulted in an investigation and ultimately a recall of only 7 implant vials with a micro-crack on the cap. This cosmetic blemish DID NOT effect the sterile seal of the package and Implant Direct has received the Official Recall Completion Notice from Health Canada. Ms. Fussi, is currently being sued by Implant Direct and the extent of her actions and Nobel's involvement are detailed in a WRIT OF SUMMONS, filed with the Supreme Court of British Columbia.

Nobel has been warned by Implant Direct's attorney to cease misrepresenting the posting on Health Canada's website which only states that dentists should contact Implant Direct to see which product lot numbers were effected. In fact, all the doctors who received pre-September 2007 products that may have exhibited the micro-crack were contacted by Implant Direct. A status report sent by Implant Direct on September 16, 2009 to Health Canada informed them that all effected customers had been contacted. This lead to Health Canada subsequently closing this issue. Nobel's underhanded actions backfired on them because it resulted in Implant Direct filing a Medwatch Report with the FDA and Health Canada that included dye leak tests conducted by an independent FDA Certified Lab. This standard test required to validate seal integrity of sterile products, demonstrated that Nobel's implant vials fail to maintain a seal as required by the FDA to claim that the contents remain sterile for a 5 year shelf life. This test was duplicated for a stock analyst and confirmed the failure of seal integrity. The stock analyst subsequently prepared a report explaining the FDA's requirements for sterile packaging and speculated as to the potential of a recall of Nobel's implants.

The investment community seems to be showing concern about Nobel's potential implant recall due to packaging issues as evidenced by a drop in Nobel's stock price of almost 16% from September 29 through October 29. This represents a substantial asset value loss during a period where Straumann's stock remained flat. Hiring Ms. Adele Fussi may be Nobel's most expensive acquisition and the fiasco created by Nobel's strategy of trying to discredit Implant Direct instead of competing with it on the basis of product features, innovations, benefits, value and customer service may have contributed to substantial changes in the management of the company.
